This Policy applies to personal information collected through tin2.tirgan.ca and related subdomains, newsletter sign-ups, waitlist and event inquiries, volunteer, sponsor, and donor submissions, festival-related communications, and other online or offline interactions connected to Tirgan — including the Tirgan World Tour, beginning with Southern California in Summer 2027, and future tour stops that Tirgan decides.

1. Scope of These Terms

These Terms apply to your use of Tirgan.ca and pages, content and online features operated by Tirgan.

Certain activities may be governed by additional terms, including:

  • ticket purchases and event attendance;
  • donations;
  • contests and competitions;
  • artist, vendor, sponsor or volunteer applications;
  • memberships or special programs;
  • merchandise or other purchases; and
  • services provided through third-party platforms.

Where additional terms are provided for a particular transaction, event, program or activity, those additional terms will apply. If there is a conflict between these Terms and more specific terms relating to that activity, the more specific terms will govern.

2. About Tirgan

Tirgan is a non-partisan, non-religious cultural organization committed to celebrating and promoting Iranian and Persian arts and culture and fostering cross-cultural dialogue through festivals, performances, educational initiatives, artistic programming and community engagement.

The Website provides information about Tirgan, its programs, events, artists, speakers, supporters, volunteers, partners, history and other activities.

3. Permitted Use of the Website

You may access and use the Website for lawful, personal, informational and non-commercial purposes.

You may share links to publicly available Tirgan webpages and use built-in sharing functions where available.

Unless expressly permitted by Tirgan or applicable law, you may not reproduce, republish, distribute, modify, sell, license, publicly display, commercially exploit or create derivative works from Website content.

4. Prohibited Uses

You agree not to use the Website in any manner that could harm Tirgan, other users, the Website or any third party.

Without limiting the foregoing, you may not:

  • use the Website for unlawful, fraudulent, abusive or misleading purposes;
  • attempt to gain unauthorized access to the Website, its servers, systems or accounts;
  • interfere with the security, operation or functionality of the Website;
  • introduce viruses, malware, malicious code or other harmful technology;
  • impersonate Tirgan, its representatives or another person or organization;
  • submit material that is defamatory, threatening, discriminatory, hateful, obscene, unlawful or otherwise infringes the rights of another person;
  • remove copyright, trademark, attribution or other proprietary notices;
  • use Tirgan’s name, trademarks, logos or branding in a manner that suggests an unauthorized affiliation, sponsorship or endorsement;
  • scrape, crawl, harvest, copy or systematically extract Website content or data through automated means without Tirgan’s prior written permission, except for ordinary search-engine indexing consistent with applicable Website instructions;
  • use Website content to create commercial databases or datasets without authorization; or
  • use substantial amounts of Tirgan’s Website content for training, developing or improving artificial intelligence or machine-learning systems without prior written authorization from Tirgan.

Tirgan may restrict or terminate access to the Website where we reasonably believe these Terms have been violated.

5. Intellectual Property

Unless otherwise indicated, the Website and its content—including text, graphics, photographs, videos, audio, designs, logos, artwork, documents, publications, databases, software and other materials—are owned by Tirgan or used with permission from artists, photographers, writers, partners, licensors or other rights holders.

Such material may be protected by Canadian, U.S. and international copyright, trademark and other intellectual property laws.

Nothing in these Terms transfers any ownership rights to you.

Tirgan Name and Marks

“Tirgan,” the Tirgan logo and related names, designs, marks and branding may be trademarks or otherwise protected intellectual property of Tirgan.

You may not use Tirgan’s name, logo or branding for advertising, merchandising, fundraising, endorsement, sponsorship or other commercial purposes without prior written permission.

Fair Dealing and Other Legal Rights

Nothing in these Terms is intended to restrict uses that are expressly permitted under applicable copyright law, including applicable fair-dealing rights.

When Website content belongs to a third party, additional restrictions imposed by that rights holder may apply.

6. Artist, Speaker and Third-Party Content

The Website may feature works, biographies, photographs, videos, interviews, statements or other content involving artists, speakers, writers, community leaders, partners or other third parties.

The views and opinions expressed by artists, speakers, interviewees, contributors or other third parties are their own and do not necessarily represent the views or positions of Tirgan.

The inclusion of an individual, organization, sponsor, partner, product or service on the Website does not necessarily constitute an endorsement except where expressly stated.

7. User Submissions

You may have opportunities to submit information or materials through the Website, including contact inquiries, applications, feedback, photographs, documents, contest entries or other content (“Submissions”).

You are responsible for ensuring that you have the right to provide any Submission you send to Tirgan and that your Submission does not violate applicable law or the rights of another person.

Unless specific submission terms, contest rules, releases or agreements state otherwise, submitting material to Tirgan does not transfer ownership of your intellectual property to Tirgan.

You grant Tirgan only the rights reasonably necessary to receive, review, store and process your Submission for the purpose for which it was provided.

If Tirgan wishes to publish, reproduce or use submitted creative material for promotional, editorial or other purposes beyond what was reasonably contemplated when it was submitted, additional permission or applicable program terms may be required.

Suggestions, ideas or general feedback about Tirgan or the Website that are not submitted confidentially may be used by Tirgan without obligation to compensate you.

8. Sponsorship, Vendor and Volunteer Inquiries

Submitting a sponsorship, vendor, partner or volunteer inquiry or application through the Website does not, by itself, create a contractual, partnership, agency, employment or other legal relationship with Tirgan, and does not guarantee selection, acceptance or participation.

Any resulting sponsorship, vendor, partner or volunteer arrangement may be governed by a separate agreement, waiver, code of conduct or other applicable terms. Volunteer opportunities are intended to be voluntary and unpaid. Any paid role will be identified separately and may be subject to different terms. Nothing in these Terms determines a person’s legal employment status under applicable law.

9. Tickets, Events and Registrations

Information about events, artists, venues, schedules, ticket availability and programming may change.

Tirgan may add, remove, substitute, postpone, reschedule or otherwise modify programs, artists, speakers, venues, dates or event details when reasonably necessary.

Tirgan may also postpone, reschedule, relocate, materially modify or cancel an event because of circumstances beyond its reasonable control, including severe weather, public-health or government requirements, venue unavailability, travel disruption, labour disputes, safety concerns or similar events. Any applicable refund, credit, transfer or rescheduling rights will be governed by the specific ticket or event terms presented at the time of purchase or registration and by applicable law.

Ticket purchases and event attendance may be governed by separate ticketing, admission, refund, venue and event policies presented at the time of purchase or registration.

Tickets may also be processed or issued through third-party ticketing providers. Those providers may have their own terms and privacy policies.

Where required by applicable law, your statutory consumer rights continue to apply regardless of anything contained in these Terms.

10. Donations

Tirgan may provide opportunities to make donations in Canada, the United States or other supported jurisdictions.

Donations may be processed by Tirgan or through third-party payment and charitable-giving platforms.

Eligibility for charitable tax receipts depends on the recipient organization, applicable tax law, the nature of the contribution and any benefits received in connection with the donation.

Any specific donation terms, receipting information or refund policies presented during the donation process will apply to that donation.

11. Third-Party Websites and Services

The Website may contain links to or integrations with third-party websites and services, including ticketing providers, payment processors, donation platforms, social networks, maps, video platforms, event venues and other external services.

Tirgan does not control these third-party services and is not responsible for their availability, security, content, privacy practices, policies or performance.

Your use of third-party services is governed by the applicable third party’s own terms and policies.

A link from Tirgan to another website does not, by itself, constitute an endorsement of that website or its operator.

12. Privacy

Your privacy is important to us.

Tirgan’s collection, use, storage and disclosure of personal information is described in our Privacy Policy, which should be read together with these Terms.

Third-party service providers may also collect or process personal information under their own privacy policies.

13. Email and Electronic Communications

Tirgan may offer newsletters, festival announcements, ticket information, organizational updates and other electronic communications.

Where consent is required by applicable law, promotional or commercial electronic communications will be sent in accordance with your communication choices and applicable requirements.

You may unsubscribe from non-essential marketing communications using the unsubscribe mechanism provided in those communications.

Tirgan may still send transactional, administrative or operational communications where reasonably necessary to respond to a request, administer a transaction or provide information relating to a service, registration, donation or event with which you have engaged.

14. Website Information and Availability

Tirgan works to keep Website information accurate and current. However, errors, omissions, outdated information or technical issues may occasionally occur.

Website content is provided for general informational purposes and may be changed, corrected or updated from time to time.

Tirgan does not guarantee that:

  • the Website will always be available or uninterrupted;
  • the Website will be free from errors or harmful components;
  • all information will always be complete or current; or
  • every announced program, artist, venue, schedule or feature will remain unchanged.

Where Website information relates to a transaction or event, any applicable purchase confirmation, ticket terms or specific event notice may provide more authoritative information.

15. Disclaimer of Warranties

To the maximum extent permitted by applicable law, the Website and its content are provided on an “as is” and “as available” basis.

Tirgan makes no warranties or representations, express or implied, regarding the Website’s availability, accuracy, completeness, reliability, security or fitness for a particular purpose.

Nothing in these Terms excludes any warranty, condition or legal right that cannot lawfully be excluded.

16. Limitation of Liability

To the maximum extent permitted by applicable law, Tirgan and its directors, officers, employees, volunteers, contractors and representatives will not be liable for indirect, incidental, special, consequential or punitive loss or damages arising out of or relating to your use of, inability to use, or reliance on the Website or Website content.

Tirgan is not responsible for losses caused by third-party websites, services or platforms that are outside Tirgan’s reasonable control.

Nothing in these Terms limits or excludes liability where doing so would be prohibited by applicable law.

Separate waivers, conditions of admission or event terms may apply to participation in or attendance at Tirgan events and activities.

17. Indemnification

To the extent permitted by applicable law, you agree to be responsible for claims, losses or expenses arising from your unlawful misuse of the Website, your violation of these Terms or your infringement of another person’s intellectual property or other legal rights.

This provision does not apply to the extent that a claim results from Tirgan’s own acts or omissions.

18. Copyright or Intellectual Property Concerns

Tirgan respects intellectual property rights.

If you believe material appearing on the Website infringes copyright or another intellectual property right, please contact us and provide sufficient information for us to identify and review the material, including:

  • your name and contact information;
  • identification of the protected work or right;
  • identification or location of the material in question; and
  • an explanation of why you believe the use is unauthorized.

Tirgan may remove or restrict access to material where appropriate.

19. Changes to the Website and These Terms

Tirgan may update the Website and these Terms from time to time.

When these Terms are revised, the “Last Updated” date at the top of this page will be changed.

Material changes may also be communicated through the Website or by other reasonable means where appropriate.

Your continued use of the Website after revised Terms become effective constitutes acceptance of the revised Terms, subject to any rights available to you under applicable law.

20. Suspension or Termination

Tirgan may suspend, restrict or terminate access to all or part of the Website if reasonably necessary for security, maintenance, legal compliance or enforcement of these Terms.

Sections of these Terms that by their nature should continue after termination—including provisions concerning intellectual property, disclaimers, liability and governing law—will continue to apply.

21. Governing Law

These Terms and your use of the Website are governed by the laws of the Province of Ontario and the applicable federal laws of Canada, without regard to conflict-of-law principles, except where mandatory laws in another jurisdiction apply.

Subject to any rights you may have under applicable consumer or other mandatory law, disputes relating solely to use of the Website will be subject to the jurisdiction of the courts located in Ontario, Canada.

Specific transactions, events or services operated by Friends of Tirgan USA or another Tirgan entity may be governed by additional terms and applicable local law.

22. Severability

If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be interpreted or limited to the minimum extent necessary, and the remaining provisions will continue in effect.

23. No Waiver

If Tirgan does not immediately enforce a provision of these Terms, that does not constitute a waiver of Tirgan’s right to enforce that provision in the future.
